Control de convencionalidad y autoprecedente interamericano
The reflections proposed in this book propose a tool that contributes to the adequate realization of the control of internal conventionality by the States while contributing to the strengthening of the Inter-American Human Rights System. In the first instance, the current state of the control of internal conventionality is approached in the light of the jurisprudence of the Inter-American Court of Human Rights, and then analyze whether respect for self-growth constitutes an instrument that contributes to its applicability. For the study of jurisprudence development, all judgments of contentious cases were selected in which the Inter-American Court has expressly mentioned the figure of the control of internal conventionality, starting in 2006, the year in which it issued the judgment of the Almonacid Arellano case v. Chile, in which this figure was mentioned for the first time, until the end of 2014.
